Terms of service
Last updated· Version1.0
Notice —This document is a draft. The bracketed items must be completed before the service goes live.
These terms of service (the “Terms”) govern access to and use of the Quick Wallet mobile application. By creating an account or using Quick Wallet, you accept these Terms in full. If you do not accept them, do not use the service.
1. Who publishes the service
Quick Wallet is published by [TO BE COMPLETED: exact legal name], [TO BE COMPLETED: legal form] with a share capital of [TO BE COMPLETED: share capital], registered under number [TO BE COMPLETED: registration number], with its registered office at [TO BE COMPLETED: full postal address] (the “Publisher”, “we”).
Publication director: [TO BE COMPLETED: name and role]. Contact: [TO BE COMPLETED: contact email] — [TO BE COMPLETED: support phone number].
Application and data hosting: [TO BE COMPLETED: host name, legal entity and address].
Quick Wallet is part of the Quick Business ecosystem. The underlying payment services are provided [TO BE COMPLETED: state the exact regulatory status — licensed payment institution, agent of a licensed institution, partnership with a payment service provider — together with the licence number and the authority that issued it].
To be completed before going live. Until this paragraph is filled in, the service must not be submitted to the app stores: the exact regulatory status determines the wording of sections 6, 7 and 12.
2. Definitions
- Application: the Quick Wallet mobile application, on Android and iOS.
- Quick Account: the single identity of the Quick Business ecosystem, used to sign in to Quick Wallet and to the other Quick services. It holds your email address and password.
- Quick Wallet account: your profile and your wallets within the Application.
- Wallet: the electronic balance held in a given currency. A Quick Wallet account may hold several Wallets.
- Operation: a top-up, a transfer, a withdrawal, a merchant payment, a currency exchange or a savings movement.
- Payment provider: a partner through which funds pass during a top-up or a withdrawal (mobile money operator, bank, aggregator).
3. Eligibility
Access to Quick Wallet requires:
- being a natural person of at least [TO BE COMPLETED: minimum age] years old with legal capacity, or acting on behalf of a duly authorised legal entity;
- holding a valid Quick Account;
- residing in a country where the service is open;
- providing accurate information and keeping it up to date.
We may refuse, suspend or close a registration where any of these conditions is not met, or where the law or our anti-money-laundering and counter-terrorist-financing obligations require it.
4. Account creation and the Quick Account identity
Registration uses an email address, confirmed by a one-time code. Your identity is carried by a Quick Account, shared with the other services of the Quick Business ecosystem.
An important consequence: deleting your Quick Wallet account does not delete your Quick Account, nor the other Quick services it gives access to. The procedure and the scope of each deletion are described in section 11 and on the Delete my account page.
5. Phone number and identity verification
Your phone number must be verified with a code received by SMS before any operation that moves money: it is the number by which a merchant or a relative identifies you.
Depending on the amount, frequency or nature of your operations, we may also ask you to prove your identity (identity document, proof of address, selfie). These checks answer legal obligations. As long as a requested check has not been completed, some operations may be restricted or capped.
The applicable limits are those published [TO BE COMPLETED: where the limits are published — in the app, on this page, on request] and may be revised.
6. Available operations
Subject to sections 3 and 5, the Application allows you to:
- top up a Wallet from a supported payment method;
- transfer to another Quick Wallet user, identified by their phone number;
- withdraw from a Wallet to a supported payment method;
- pay a merchant that accepts Quick Wallet;
- exchange between supported currencies;
- save, through plans whose funds may be locked until the agreed maturity date;
- review the history of your operations.
Funds held in a Wallet do not earn interest, unless expressly stated for a specific savings product.
An Operation is irrevocable once confirmed. In particular, a transfer sent to the wrong number cannot be unilaterally reversed: check the recipient before confirming. We may assist you in an amicable approach to the beneficiary, with no guarantee of outcome.
We may refuse, delay or block an Operation, in particular where fraud is suspected, where the law requires it, where funds are insufficient, where a limit is exceeded, or where a Payment provider is unavailable.
7. Fees, exchange rates and penalties
The fees applicable to each type of Operation, the exchange rates and any penalties (in particular for the early termination of a savings plan) are set out in the fee schedule in force, [TO BE COMPLETED: state where the schedule is published and how it is communicated].
The Application shows the applicable fees before you confirm each Operation. The amount shown on that screen governs the Operation concerned.
Exchange rates vary. The rate applied is the one displayed at the time of confirmation.
We may amend the fee schedule. Any amendment is brought to your attention [TO BE COMPLETED: notice period and notification channel] before it takes effect.
8. Keeping your account secure
Your account is protected by:
- a password attached to your Quick Account;
- a 6-digit PIN, which never leaves your device in clear text;
- where applicable, your phone’s biometric unlock (fingerprint or face). Biometrics only unlock the session in place of the PIN; they never authorise an Operation, which is always proved server-side using the PIN. No biometric data leaves your device and we have no access to it.
You undertake to keep these secret, not to disclose them, and not to lend an unlocked device. Any Operation confirmed with your security credentials is deemed to have been carried out by you.
Tell us immediately at [TO BE COMPLETED: emergency email / phone] if your device is lost or stolen, or if you suspect your credentials have been compromised. We will never ask you for your password, your PIN or a code received by SMS, through any channel whatsoever.
9. What you undertake not to do
It is prohibited to use Quick Wallet in order to:
- launder money, finance terrorism or conceal the origin of funds;
- carry out an operation on behalf of a third party without having declared it to us;
- provide false information or impersonate another person;
- sell unlawful goods or services, or carry out any activity prohibited by applicable law;
- circumvent limits, artificially split operations, or exploit a technical fault in the service;
- harm the security or availability of the service, in particular through unauthorised automated access, reverse engineering or intrusion attempts.
10. Suspension and blocking
We may suspend all or part of your access, freeze a Wallet or block an Operation — without notice where urgency or the law requires it — in the event of:
- suspected fraud, abuse or unusual activity;
- a breach of these Terms;
- an order from a competent authority;
- an identity check requested and not completed;
- an open dispute over an Operation.
We inform you as soon as possible and to the extent the law allows.
11. Closing and deleting your account
You may request the deletion of your Quick Wallet account at any time, from the Application [TO BE COMPLETED: location of the in-app screen once shipped] or from the public Delete my account page.
Scope. The request covers your Quick Wallet account. Your Quick Account, shared with the other Quick Business services, is not deleted by this request; the corresponding procedure is described on the deletion page.
What may prevent immediate deletion: a non-zero balance, an Operation in progress, an open dispute, or an active savings plan whose funds are locked. In those cases we tell you what to do (withdraw the balance, wait for maturity, resolve the dispute) before we proceed.
What is kept after deletion. Some data must be retained beyond closure to meet our legal obligations, in particular anti-money-laundering and accounting record-keeping rules: your Operation identifiers, amounts, dates, and the identity documents collected. This data is retained for [TO BE COMPLETED: statutory retention period and its legal basis] and is then deleted or anonymised. The detail is in the privacy policy.
We may also close your account, with [TO BE COMPLETED: notice period] notice, or without notice in the event of a serious breach. Your available balance is returned to you as set out in [TO BE COMPLETED: terms and timeframe for returning the balance].
12. Liability
We undertake to provide the service with due care, but the Application is provided “as is” and we do not guarantee uninterrupted availability: maintenance, a Payment provider outage, a telecom operator failure or force majeure may interrupt it.
We are not liable for:
- the consequences of incorrect information you entered, in particular a wrong recipient number;
- use of your account by a third party to whom you disclosed your security credentials;
- the unavailability, delays or fees of a Payment provider;
- indirect damage.
Where our liability is engaged, it is limited to [TO BE COMPLETED: liability cap, to be validated by counsel].
Nothing in these Terms excludes a liability that applicable law does not allow to be excluded.
13. Complaints
Any complaint may be sent to [TO BE COMPLETED: complaints email], quoting the reference of the Operation concerned. We acknowledge receipt within [TO BE COMPLETED: acknowledgement timeframe] and answer within [TO BE COMPLETED: response timeframe].
Where a disagreement persists, you may refer the matter to [TO BE COMPLETED: competent mediator or appeal body, if any].
14. Intellectual property
The Application, its trade marks, logos, interface and content are protected. These Terms grant you a personal, non-exclusive, non-transferable right to use the Application for the lifetime of your account. Any other use requires our prior written agreement.
15. Changes to these Terms
We may amend these Terms. The applicable version is the one published on this page. Any substantial change is notified to you [TO BE COMPLETED: channel and notice period] before it takes effect. Continuing to use the service after that date constitutes acceptance; failing that, you may close your account under section 11.
16. Governing law and jurisdiction
These Terms are governed by the law of [TO BE COMPLETED: governing law]. Failing an amicable resolution, disputes fall within the jurisdiction of [TO BE COMPLETED: competent courts], subject to the mandatory rules protecting consumers.
17. Contact
[TO BE COMPLETED: legal name] — [TO BE COMPLETED: postal address] Email: [TO BE COMPLETED: contact email] Data protection: [TO BE COMPLETED: data protection officer or contact email]
